Catastrophic Injuries

Catastrophic Injury Overview

Dealing with cases involving catastrophic injuries can be difficult. An effective personal injury attorney will need to have the experience and access to medical experts and medical records to accurately evaluate the value of an accident or injury lawsuit that involves serious injuries. Fortunately, Goodwin Law Corporation has represented victims in California for over 20 years who have been seriously or fatally injured because of the negligence of a third-party.

What is a Catastrophic Injury?

A catastrophic injury is any personal injury that has lasting consequences on a victim’s life. It is often an injury that is permanent, debilitating and/or causes the victim immense pain. There are many different types of catastrophic injuries that a person may sustain, including:

  • Brain damage
  • Spinal cord injuries
  • Neck injuries
  • Head injuries
  • Burn injuries
  • Loss of eyesight or hearing
  • Paralysis
  • Nerve damage
  • Amputations

These types of injuries are deemed catastrophic because they present many physical limitations that can impact a person’s quality of life on a permanent basis. They also often demand ongoing medical treatment from doctors, physical therapists, specialists and psychologists. Without prompt and effective treatment, catastrophic injuries may become worse or cause new symptoms to develop.

Steps to Take After a Catastrophic Injury

Most of the time the first priority for a victims of catastrophic injury is to seek and obtain appropriate medical diagnosis and treatment. After the initial diagnosis, a victim of a catastrophic injury should start to consider legal action. This is especially true in cases where the victim has suffered irreversible damage which will demand continuous medical care.

If you or someone you love has been involved in a catastrophic injury, it is very important that you do not delay in filing a claim. In California, a Statute of Limitations may prevent you from taking any legal action related to the catastrophic injury if too much time has passed. Additionally, it is imperative to secure evidence and begin an immediate investigation to determine if someone else is responsible for the catastrophic injury. We have personally seen instances where victims of catastrophic injuries have waited too long to seek a lawyer and have either been precluded from bringing a suit or have lost their medical records.

Once it is determined the catastrophic injury was caused by a third party, we will file a suit to help you or someone you love to recover damages. Once a suit is filed, we will begin an investigation as to how and where the catastrophic injury occurred.  We will also review all of your medical records and consult with physicians or other expert witnesses to determine the severity and damages resulting from the injury.
